Acceptance
These Terms of Use (“Terms”) govern your access to and use of the Agapio mobile application and related services (the “Service”)
provided by Agapio Team (“Agapio,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and
have the legal capacity to enter into these Terms.
About the Service
Agapio transforms your solo living experience into an art of mindful routines and meaningful habits. Features may include:
- Daily Ritual Manager: organize activities and schedule routines
- Habit Tracker for Growth: track habits, visualize progress, and celebrate milestones
- Capture Your Moments: journaling/reflections with optional photo attachments
- Embrace Structure and Joy: tools to help structure everyday life
Accounts
You may be required to create an account. You agree to:
- Provide accurate and up-to-date information (such as name/username/email)
- Maintain the security of your account credentials
- Notify us promptly if you suspect unauthorized access
You are responsible for all activity that occurs under your account.
License & App Store terms
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install
and use the Service for your personal, non-commercial use.
Apple App Store notice
If you download the app from the Apple App Store, you also agree to Apple’s applicable terms and acknowledge that Apple is not
responsible for the Service or its content and has no obligation to provide maintenance or support.
Your content
“User Content” means content you submit, post, store, or otherwise make available through the Service, including routines, habit
entries, notes, reflections, and photos.
You retain ownership of your User Content. You grant Agapio a limited license to host, store, reproduce, and process your User
Content only as necessary to operate and provide the Service and to deliver features you request.
You represent and warrant that you have the rights to submit your User Content and that doing so does not violate any law or
third-party rights.
Prohibited conduct
- Use the Service for unlawful, harmful, or fraudulent purposes
- Harass, abuse, or threaten others
- Interfere with or disrupt the Service, or attempt unauthorized access
- Reverse engineer or attempt to extract source code except where prohibited by law
- Upload malware or content that could damage the Service
Privacy
Our privacy practices are described in our Privacy Policy, provided separately. By using the Service, you acknowledge that we may
collect and use information as described there.
Updates & changes
We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may also update these Terms and will
update the effective date when changes take effect. Continued use after the effective date constitutes acceptance.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if termination is
reasonably necessary to protect the Service, users, or our rights.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR
IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or secure.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGAPIO TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR
PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE
SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS
WILL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD
$50 IF YOU PAID NOTHING.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Agapio Team from and against any claims, liabilities, damages, losses, and
expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service or your violation of these
Terms.
Disputes, arbitration & governing law
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service
will be resolved by binding arbitration. The governing law will be the laws of the jurisdiction of our principal place of business,
without regard to conflict of laws principles.
Arbitration will be conducted on an individual basis and not as a class, collective, or representative action, to the extent
permitted by law.
